Registered Nurse Defended Against Drug Diversion Allegations

Cory Silkman, a professional license defense attorney in Maryland, successfully represented a registered nurse at an evidentiary hearing before the Maryland Board of Nursing.
The nurse was accused of diverting drugs from a hospital, and violating medication administration policies and procedures by failing to document medication administration and wasting procedures. The charges carried a maximum penalty of revocation of the nurse's license, as well as a significant fine.
Mr. Silkman vigorously cross-examined witnesses from the hospital, and put forward evidence that the hospital's electronic medical record system had significant flaws that caused numerous discrepancies in the medication counts and medication administration record. Mr. Silkman also challenged the for-cause drug test results that allegedly showed the nurse had an illicit substance in her body. The nurse testified on her own behalf about her experience on the unit and with the flawed technology system, as well as her own prescribed medications that accounted for the drug test results.
Following the hearing, the Maryland Board of Nursing dismissed all charges against the nurse. She was successfully defended against the false allegations, and her license was not disciplined.
